As funções que competem ao vereador de acordo com a constituição de 1988

O governo municipal divide-se em dois poderes independentes entre si, o Executivo (Prefeitura) e o Legislativo (Câmara de Vereadores), e independentes aos poderes e órgãos da União e dos Estados.

As funções que competem à atuação municipal estão previstas na Constituição Federal de 1988. Um município pode formular suas próprias leis,  desde que não entrem em conflito com as leis de outras esferas, e têm autonomia para editar suas próprias Leis Orgânicas, ou seja, a compilação dos direitos, poderes e prioridades municipais.

O vereador  desempenha como funções típicas as tarefas de legislar e de exercer o controle externo do Poder Executivo. A função legislativa consiste em elaborar, apreciar, alterar ou revogar as leis de interesse para a vida do município. Essas leis podem ter origem na própria Câmara ou resultar de projetos de iniciativa do Prefeito, ou da própria sociedade, através da iniciativa popular.

Existem dois tipos de funções desempenhadas pelo vereador: função típica e função atípica.

A função típica consiste em legislar e fiscalizar. A atividade legislativa do vereador permite as seguintes proposições à Câmara:

Proposta de emenda: o vereador pode criar uma proposta para alterar a lei Orgânica do município, mas essa proposta tem uma tramitação diferenciada na Câmara: é votada em dois turnos e aprovada por dois terços dos vereadores da casa.

Projetos de lei: são as proposições que têm por finalidade regular as matérias no município e que precisam ser sancionadas pelo prefeito. Os vereadores podem apresentar projetos de Leis Complementares, projetos de Leis Ordinárias e projetos de Leis Delegadas. Vale ressaltar que quem apresenta um projeto de lei é o dono da iniciativa, porém, quando a lei é aprovada, passa a ser uma lei da Câmara.

Projetos de Resolução: são atos que tem efeito apenas no interir da Câmara e não necessitam da sanção do prefeito para a sua promulgação. Os projetos de resolução tratam de temas como a criação de Comissões Especiais, elaboração do Regimento Interno, destituição da mesa ou de qualquer de seus membros, concessão de licença a vereadores, etc.

Projetos de decreto legislativo: são normas que só podem ser definidas pela Câmara de Vereadores e provocam efeitos externos. Para entrar em vigor não têm que passar pela sanção do prefeito. Exemplos desse tipo de matéria são a concessão de títulos honoríficos e a aprovação ou rejeição das contas do município.

Emendas a projetos de lei, de resolução ou de decreto legislativo: são posições apresentadas pelo vereador, quando ele deseja alterar a forma ou o conteúdo da posição principal: projetos de lei, de resolução ou de decreto legislativo.

Indicação ao executivo e aos vereadores: é uma espécie de sugestão por escrito apresentada pelo vereador. Através da indicação, o vereador pode sugerir medidas de interesse público aos Poderes competentes ou também  para sugerir a manifestação de uma ou mais comissões sobre determinado assunto, visando à elaboração de projeto sobre matéria de iniciativa da Câmara.

Moções: são as proposições em que é sugerida a manifestação, apelo, congratulação ou protesto da Câmara sobre determinado assunto.

Requerimentos: são um instrumento muito comum nos trabalhos legislativos. Através deles, o vereador pode solicitar providências administrativas e relativas ao Regimento Interno, bem como obter informações da Mesa Diretora da Câmara, do prefeito ou de qualquer outra autoridade do Executivo municipal.

Parecer: é o pronunciamento da Comissão ou da Assessoria técnico-legislativa sobre matéria sujeita ao seu estudo Normalmente é oferecido por escrito pelo relator da matéria.

Recurso: é a posição destinada a alterar decisões tomadas por órgãos da Casa – Presidência da Câmara, Presidências das Comissões, Mesa Diretora e Comissões.

Como funções atípicas, a Câmara tem competência administrativa para:

Gerenciamento do próprio orçamento, patrimônio e pessoal;

Organização dos serviços (composição da Mesa Diretora, organização e funcionamento das comissões);

E judiciária para:

Processar e julgar o prefeito por crime de responsabilidade;

Julgar os próprios vereadores, inclusive o Presidente da Câmara, em caso de irregularidades, desvios éticos ou falta de decoro parlamentar.

The functions conferred upon the city council in accordance with the constitution of 1988

 The city government is divided into two mutually independent powers, the Executive (Town Hall) and the Legislative (City Council), and independent powers and organs of the Union and the States.

The functions that compete for municipal operations are provided in the Federal Constitution of 1988. A municipality can make its own laws, provided they do not conflict with the laws of other spheres, and are empowered to edit their own organic laws, namely the compilation of the rights, powers and municipal priorities.

Councilman plays as functions typical tasks to legislate and exercise external control of the Executive Branch. The legislative function is to develop, assess, amend or repeal the laws of interest for the life of the city. These laws may originate in the House itself or the result of projects initiated by the Mayor, or society itself, through popular initiative.

There are two types of functions performed by Alderman: function typical and atypical function.

A typical function is to legislate and monitor. The legislative activity of Councilman allows the Board the following propositions:

Proposed Amendment: Councilman can create a proposal to amend the Organic Act of the city, but this proposal has a different procedure in the House: it voted in two readings and approved by two thirds of the councilors of the house.

Bills: are the propositions that are designed to regulate matters in the city and need to be sanctioned by the mayor. The council may submit projects Complementary Laws, Laws Common projects and projects Laws Delegates. It is noteworthy that whoever presents a bill owns the initiative, however, when the law is passed, it becomes a law of the House.

Draft Resolutions: are acts that have effect only in interir the House and do not need the sanction of the mayor for their enactment. The draft resolutions dealing with issues such as the creation of special committees, drafting of internal regulations, dismissal of the table or any of its members, the councilors licensing, etc..

Draft legislative decree: are standards that can only be set by the Board of Aldermen and cause external effects. To enter into force do not have to go through the sanction of the mayor. Examples of such matter are granting honorary degrees and approval or rejection of the accounts of the municipality.

Amendments to bills, resolutions or legislative decree: positions are presented by councilor when he wants to change the form or content of primary position: bills, resolutions or legislative decree.

Nomination and executive councilors: it is a kind of suggestion in writing presented by councilman. Through the statement, the councilor may suggest measures of public interest or to the competent Authorities also to suggest the manifestation of one or more committees of the issue, aiming to design drafting committee on the initiative of the Chamber.

Motions: are the propositions that are suggested in the protest, appeal, or congratulation protest the House on an issue.

Appeal: the position is to amend decisions made by organs of the House - Chair of the Board, Committee Chairs, Officers and Committees.

As atypical functions, the Board has administrative competence to:

Management's own budget, personnel and assets;

Organization of services (composition of Officers, organization and functioning of committees);

And judicial to:

Adjudicate the mayor for criminal liability;

Judging own councilors, including the Mayor, in case of irregularities, ethical misconduct or lack of parliamentary decorum.
